Pre-Launch Terms & Conditions

These Pre-Launch Terms & Conditions apply to the registration and use of Pensative AI, which is currently in a pre-launch development phase.

By registering on the platform, the user expressly agrees to the following terms.

1. Product Nature (Pre-Launch)

The user acknowledges and agrees that:

• The platform is under active development
• Some features may be unavailable or experimental
• The final product may differ from early presentations
• Access may be limited during the pre-launch phase

2. Prohibition of Competitive Use

Registered users may not:

• Use the platform’s idea, concept, architecture, or business model
• Create, copy, clone, or launch competing products or services
• Reproduce the platform for commercial or non-commercial purposes

All intellectual property belongs exclusively to Pensative AI.

3. Service Availability

The company commits to:

• Maintaining product availability for a minimum of three (3) years after the official launch

After this period:

• Service continuity will depend on monetization and sustainability
• The company reserves the right to modify, suspend, or discontinue the service

4. Launch Delays

The user acknowledges that:

• The official launch may be delayed by up to twelve (12) months
• Such delays do not constitute a breach of agreement
• Development timelines may change for technical or strategic reasons

5. Account Name (Username)

• The selected account name will be reserved exclusively for the user
• The platform will not assign the same name to another user while the account is active

5.1 Business Name Conflicts

If a username matches the legal name of a company registered with:

• FUNDEMPRESA
• SEPREC
• Or any other official registry in Bolivia

The legal business entity shall have priority rights over the name.
The platform may request a username change or reclaim the name.

6. Artificial Intelligence Usage

The platform uses Artificial Intelligence to generate websites.

The user acknowledges that:

• AI-generated content may vary in quality and originality
• Content may not be legally registrable
• Similar results may exist for other users

Users are responsible for reviewing and validating generated content before public or commercial use.

7. No Guarantee of Results

The company does not guarantee that:

• Generated websites will be commercially successful
• Websites will generate traffic or revenue
• Specific business outcomes will be achieved

The service is provided "as-is" during pre-launch.

8. Product & Pricing Changes

The company reserves the right to:

• Modify pricing or subscription plans
• Add or remove features
• Change service structure

Material changes will be communicated when reasonably possible.

9. Project Discontinuation

If the project is discontinued:

• No compensation will be provided
• Data migration is not guaranteed
• Users will be notified when feasible

10. Data Protection

User data will be handled according to:

• Applicable Bolivian laws
• Industry-standard privacy practices
• The platform’s Privacy Policy

11. Governing Law

These terms are governed by the laws of:

The Plurinational State of Bolivia

Any disputes shall be resolved under this jurisdiction.

12. Acceptance

By registering on the platform, the user confirms that they have:

• Read
• Understood
• Explicitly accepted
